Buying a property in Spain step by step – Loriini Guid
Buying a property in Spain, especially on the sunny Costa del Sol, is not just an investment: it is a lifestyle decision. Marbella, Estepona, Benahavis: these places not only seduce for their beauty, but also for their potential. If you are thinking of buying a villa or apartment in Spain, it is essential to know the process from start to finish. Here is a practical guide by Loriini: a brand that combines luxury properties, interior design and comprehensive attention to the buyer.
1. Choosing the ideal property on the Costa del Sol
It all starts with a dream, but quickly becomes a concrete project. At Loriini we accompany you from the first step:
- we define your needs: private residence, investment, vacation home?
- we suggest ideal locations (e.g. Golden Mile, Marbesa, El Paraíso);
- we present you a personalized selection of properties from our Loriini Properties catalog.
Looking for a villa with sea views? An apartment near the golf course? We help you find the perfect option.
2. Reservation and legal verification of ownership
Once the property is chosen, the legal process begins. In collaboration with the law firm The Lawyerswe guarantee your legal security:
- signature of the reservation contract (usually a deposit of between 6,000 and 10,000 €),
- conducting the due diligence – we check the ownership, possible encumbrances, urban situation and taxes;
- obtaining the NIE number – identification number for foreigners, mandatory to buy in Spain.
With us there are no surprises: we verify everything for you, from documents to town planning regulations.
3. Signing of the earnest money contract
This is a key step. In this contract, both parties agree to complete the sale and purchase. The buyer provides a down payment (usually 10% of the price), and the seller agrees to sell under the agreed conditions.
If the buyer withdraws, he loses the deposit. If the seller defaults, he must return double.
4. Public deed before a notary public
The final step is the signing of the public deed before a notary. From that moment on, the property legally passes to the buyer.
At Loriini we offer:
- full legal assistance during the signing;
- translation of documents;
- representation by power of attorney (if you are unable to attend in person).
After signing, the property is officially registered in the Land Registry.
5. Costs associated with the purchase of a property in Spain
In addition to the price of the property, you must consider certain additional expenses:
| Type of expense | Estimated amount |
| ITP tax (second hand) | 7% – 10% |
| VAT + AJD (new construction) | 10% + 1,2% |
| Notary and registry | 0,5% – 1% |
| Legal fees | approx. 1%. |
| Translations / powers of attorney | as the case may be |
With Loriini you know from the beginning the total cost of the operation – no hidden costs.
